Document of agreement
Welcome to our e-bike tours and rental service, operated by Vladislav Goncharov (NIF 313044767) under the brand Irondeer (referred to as "we", "us", or "our" throughout these terms). These terms of service ("Agreement") govern your use of our website, e-bike rental services, guided e-bike tours, and related products and services (collectively, "Services"). By accessing or using our Services, you agree to be bound by these terms, as well as any additional terms and conditions that apply to specific aspects of our Services.
1. Rental Services
1.1 Eligibility: Our rental services are available to individuals who are at least 18 years old, have a valid ID card, and a credit or debit card in their name. By using our rental services, you represent and warrant that you meet these eligibility requirements.
1.2 Reservations: You can reserve an e-bike rental online or in-person at our rental location. We cannot guarantee the availability of e-bikes, so we encourage you to make a reservation in advance. All reservations require a valid credit or debit card to be held on file.
1.3 Rental Period: The rental period begins at the time you take possession of the e-bike and ends when you return it to our rental location. The rental period cannot be extended without our prior approval.
1.4 Rental Fees: Rental fees are charged based on the length of the rental period, as well as any additional charges for optional equipment or services. You are responsible for all fees and charges associated with the rental, including any damages or repairs needed as a result of your use of the e-bike.
1.5 Security Deposit: A security deposit is required for all e-bike rentals and is 200.00 € (EUR) per bicycle. The security deposit will be refunded to you upon return of the e-bike, provided that it is returned in the same condition as it was rented.
1.6 E-Bike Use: You are responsible for using the e-bike in a safe and responsible manner, in accordance with all applicable laws and regulations. You agree to return the e-bike in the same condition as it was rented, except for normal wear and tear.
2. Guided E-Bike Tours
2.1 Eligibility: Our guided e-bike tours are available to individuals who are at least 18 years old, have a valid driver's license, and a credit or debit card in their name. By using our guided e-bike tours, you represent and warrant that you meet these eligibility requirements.
2.2 Reservations: You can reserve a guided e-bike tour online or in-person at our rental location. We cannot guarantee the availability of tours, so we encourage you to make a reservation in advance. All reservations require a valid credit or debit card to be held on file.
We reserve the right to cancel or change any tour due to road, water or weather conditions. If a tour is cancelled by the company due to such circumstances, the client will not be charged.
2.3 Tour Fees: Tour fees are charged based on the length and nature of the tour, as well as any additional charges for optional equipment or services. You are responsible for all fees and charges associated with the tour, including any damages or injuries caused as a result of your participation in the tour.
2.4 Tour Duration: The duration of the tour will be determined by us and may vary depending on the tour selected. You are responsible for arriving at the designated meeting point on time and for staying with the tour group for the duration of the tour.
2.5 E-Bike Use: You are responsible for using the e-bike provided during the tour in a safe and responsible manner, in accordance with all applicable laws and regulations. You agree to return the e-bike in the same condition as it was rented, except for normal wear and tear.
The vehicle described in this rental agreement must be driven solely under the responsibility of the one who signed the rental agreement, and he will be liable for all violations of the Portuguese Highway, Civil and Criminal Codes.
3. Liability and Insurance
3.1 Liability: You assume all risks associated with the use of our Services, including the rental and use of e-bikes and participation in guided tours. We are not liable for any damages or injuries that occur as a result of your use of our services.
3.2 Insurance: Our e-bikes are covered by liability insurance, which provides coverage for damages or injuries that occur as a result of your use of the e-bike, up to the policy limits. You are responsible for any damages or injuries that exceed the policy limits, as well as any deductibles or other fees specified in the insurance policy.

3.3 Theft, loss or breakage of the frame or wheels is not covered by any insurance company in Portugal and the customer is fully responsible for the accidental theft or loss of any equipment.
4. Cancellation and Refunds
4.1 Rental Cancellations: You may cancel a reservation for an e-bike rental at any time, subject to our cancellation policy. If you cancel more than 7 days before the scheduled rental period, you will receive a full refund. If you cancel less than 7 days before the scheduled rental period, you will be charged a cancellation fee equal to 50% of the rental fee.
4.2 Tour Cancellations: You may cancel a reservation for a guided e-bike tour at any time, subject to our cancellation policy. If you cancel more than 7 days before the scheduled tour, you will receive a full refund. If you cancel less than 7 days before the scheduled tour, you will be charged a cancellation fee equal to 50% of the tour fee.
4.3 We reserve the right to refuse to participate before or during the trip any person whose behavior and/or attitude interferes with the general enjoyment and well-being of other participants on the tour and if anyone, participant or our staff, is endangered by that person. In the event of any of the of the above events, we are not responsible for any refund or payment of any compensation. In any event, we are not responsible for unused services.
4.4 We reserve the right to change itineraries or the organization of tours, If necessary or due to so-called force majeure circumstances.
4.5 We reserve the right to cancel the rental of a bicycle before it is received for any reason, in which case a refund will be issued. If we are forced to cancel the rental, we will not be liable for any fees or compensation of any kind.
5. Intellectual Property
5.1 Ownership: We own all intellectual property rights in our Services, including our website, logos, and other content. You may not use our intellectual property without our prior written consent.
5.2 Feedback: If you provide us with feedback, suggestions, or other comments about our Services, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such feedback in any form, media, or technology, whether now known or hereafter developed.
5.3 We reserve the right to use any photos or images of any kind from participants free of charge for bona fide advertising and marketing purposes.
6. Penalties and other expenses
6.1 If the bicycle is damaged, lost, stolen, stolen or damaged the customer must report it immediately. The customer will be responsible for responsibility for any damage caused to the rental materials, and will have to compensate accordingly so that they full reimbursement of the cost.

In case of loss or theft of the bicycle, the customer undertakes To pay the damages with the amount RISE H15 - 5700 €, WILD FS H20 - 5400 €, URRUN 30 - 3500 €.
6.2 When executing this contract, the customer expressly acknowledges himself as solely responsible to our company, and will also be solely responsible for all amounts payable under the contract.
6.3 Travel assistance (site visit, manpower) shall be provided free of charge within a distance of 5 km from irondeer's premises. Within a distance of more than 5 km and less than 30 km to irondeer facilities, travel assistance will cost the client €1 per kilometer travelled. For distances exceeding 30 km from irondeer territory, the client must, in case of damage, immediately contact irondeer so that they can promptly find a point as close as possible to the client, who is responsible for moving there at their own expense.
7. Delayed return
The customer must notify us by telephone of any delay that may affect the return within the time period set out in the contract. The same period of of delay will be charged to the customer €10 per hour. If the delay is twenty-four hours or more, and it is not consequence of an explicit agreement between the parties, we reserve the right to prosecute the customer for theft.
8. Breakdowns, accidents, incidents, breakdowns, thefts or accidents
8.1 In any of the above cases, which may occur during the rental period, the customer must contact irondeer. The costs of towing and repairing the bike on its premises, such as replacement parts or tires, shall be borne by irondeer, if they are caused by wear and tear or any other normal circumstances inherent in the proper use of the bike. Repairs must be carried out on the irondeer's premises or at a place designated by the irondeer.
8.2 Costs of towing and repairing the bicycle on its premises, such as replacing parts or tires, are the responsibility of the customer if caused by the customer.
8.3 In the event of a robbery, the customer is fully responsible for full payment of the bicycle and accessories.
8.4 In the event of an accident, the customer must request a report from the state authorities (PSP or GNR), a copy of which must be delivered to irondeer no later than in no more than twenty-four hours. In the case of theft/theft, the customer must immediately notify the public authority and contact irondeer, except in cases of except in cases of force majeure, accepting documentary evidence that a formal complaint has been filed with the competent authorities.
8.5 The Client expressly agrees that the Client has the right to inform to the competent authorities their identity if they have not already done so, if there is a suspicion that they have committed an offence.
9. Miscellaneous
9.1 Governing Law: This Agreement is governed by and construed in accordance with the laws of Portugal, without giving effect to any principles of conflicts of law.
9.2 Entire Agreement: This Agreement constitutes the entire agreement between you and us regarding your use of our Services and supersedes all prior agreements and understandings, whether written or oral.
9.3 Changes to Agreement: We may modify this Agreement at any time, in our sole discretion. We will provide notice of any material changes to this Agreement by posting a notice on our website or by other means. Your continued use of our Services following any such modification constitutes your acceptance of the modified Agreement.
